Cognosketch, LLC. (“we,” “us,” “our”) operates the Cognosketch Assess mobile application (the “App”). This page informs you of our policies regarding the collection, use, and disclosure of user data including personally identifiable data when you use our App and the choices you have associated with that data.

1. Information Collection and Use

We collect several different types of information and data for various purposes to provide services to you through our App and to improve user experience.

1.1 Personally Identifiable, Non-Personally Identifiable, and Device Information

Note:

  • The App does not collect personally identifiable information such as Name, Date of Birth, Address, or SSN.
  • The App does not utilize the camera, thus it does not capture any images or videos of users or individuals using the App. 
  • The app does not capture any biometric data.

All data collected is necessary for the app’s core functionality.

1.1.1.  No personally identifiable information is collected when the App is used without signing into a user account (i.e., in guest mode).

1.1.2. When creating an account, users are required to choose a unique username and provide a verifiable email address that will be used to authenticate the user.

1.1.3. Upon signing into the App, users can purchase and administer assessments. Prior to starting an assessment, the following information is required to be input:

(a) Information related to testing location: 

  • Testing center name (or Home, or any arbitrary name)
  • Zip Code
  • Country
  • Email address

This information serves the purpose of tracing the assessment to its administration location. The email address provided in this section will solely be used for sending assessment reports and will not be shared with any third parties.

(b) Information related to the person taking the assessment: 

  • Identifier – Any string literal, e.g., student id used by a school
  • Age
  • Gender
  • Handiness
  • Type of stylus used in the current assessment

These details are utilized as variables during the processing of assessment data for analysis and evaluation.

Data Anonymization – The identifier associated with the individual taking the assessment can be any arbitrary alphanumeric string and cannot be independently used to identify an individual. It is included in the assessment report for the convenience of the assessment administrator to distinguish test subjects.

(c) Device information is collected for debugging and troubleshooting purposes. This includes Device ID, which is a unique identifier assigned to each device and Device type, which specifies the model or type of device being used (e.g., iPhone X, iPad Pro). This information helps in diagnosing and resolving technical issues to improve the app’s performance and user experience.

This data is deleted from our system when the user closes their account.

1.2 Usage Data for Analytics:

We utilize event-based analytical data to maintain and ensure proper functioning of the App. This may encompass details regarding the App’s access and usage, such as your device’s identifier, usage statistics, and diagnostic information. This data influences our decisions for future updates aimed at enhancing user experience and optimizing the App’s performance.

1.3 Assessment Data:

All paid assessments are associated with a Cognosketch account. When an individual takes an assessment, the App conducts various measurements and collects data for processing. This includes measurements like speed, pressure, etc., alongside visual representations generated by the App. After processing and review, any personally identifiable information is removed from the data. The anonymized data is then integrated into the backend system for analysis and improvement purposes.

2. Use of Information

We may use the information collected for various purposes, including:

  • To provide and maintain the App;
  • To improve and personalize the App experience;
  • To analyze usage trends and monitor the effectiveness of the App;
  • To communicate with you and respond to your inquiries and requests.

Specific personally identifiable user information is used as follows:

  • The email address provided by the user when creating an account is collected only for administrative purposes such as sending purchase confirmation and other account related notifications. This information is deleted when the user deletes the account.
  • Assessment reports will be sent to the email address provided in the Testing Center Information on a device. This address will not be used for any other purpose.

3. Sharing of Information

Your information may be shared with third parties under the following circumstances:

  • With your consent;
  • To comply with legal obligations or protect our rights;
  • With service providers who assist us in operating the App;
  • In connection with a business transaction.

Consent to Share In-App Purchase Data with Apple:

Users have the option to share information regarding their in-app purchases with Apple. This data is necessary for processing refunds as required by Apple’s policies. The App provides users with the ability to enable or disable data sharing with Apple for this purpose.

4. Data Security

We employ reasonable measures to safeguard your personal information from unauthorized access, use, or disclosure. However, it’s important to note that no method of transmission over the Internet or electronic storage can guarantee absolute security.

The App initiates authorized events that are processed by our backend servers at various stages of the assessment workflow. Our servers utilize the Transport Layer Security (TLS) protocol version 1.2 to ensure secure communication. Data at rest id encrypted using standard encryption practices with AES-256.

When verifying in-app purchases and processing refunds, our servers securely interact with Apple’s App Store API. Any data received from Apple is cryptographically signed by the App Store, ensuring secure transmission.

5. Consent to Data Usage

By using the App, you expressly consent to the collection, processing, and use data collected by the app as outlined in section 1. for the purposes described in these Terms, including AI model improvement. Your consent is voluntary, and you may withdraw it at any time by discontinuing your use of the App.

6. Your Rights

You have certain rights regarding your personal information, including the right to access, correct, or delete your information. 

The App provides users with the option to close their account. Upon account closure, the following information is deleted:

  • Any information entered during registration, such as email address.
  • Purchase history
  • Assessment history

Data collected and representations generated by the App during assessments are securely stored for future enhancements to our algorithms and AI models. This data is anonymized and does not contain personally identifiable information. Following account closure, no data can be linked back to the user or the individual who took the assessment.

7. Children’s Privacy

The App may be used to assess children over the age of 3. Subject-specific information as specified in section 1.3.2 is also collected for children. If you are a parent or guardian and believe that your child has provided us with any sensitive personal information beyond what is described, please contact us.

8. Updates to Privacy Policy

We reserve the right, at our sole discretion, to modify or replace this Policy at any time. If a revision is significant, we will provide at least 30 days’ notice before the new terms take effect. By continuing to use the App after these revisions become effective, you agree to be bound by the updated policy.
